1.   Goal of Cultivation

This PhD Programme is specially tailored to cater to overseas students. The programme aims to develop well-trained scholars and practitioners in the fields of Public International Law and International Water Law with a global view, equipped with an in-depth understanding of the theoretical foundation as well as a systematic command of the knowledge and skills in the field of Public International Law and International Water Law. In particular –

1.    The PhD Programme aims to train scholars and practitioners who possessed solid and in-depth command and understanding of the theoretical foundation of Public International Law and International Water law, and an enhanced technical and professional knowledge and skills in the field of International Water Law who are capable of furthering and advancing research in the field. 

2.    The PhD Programme aims to train scholars who are capable of spearheading independent, original researches that cut across disciplines; and at the same time, capable of working with other researchers in research collaborations that contribute towards progressive development in the discipline of International Water Law.

3.    The PhD Programme is confident of training candidates who are capable of conducting research in English and are able to access recent development of, and the frontier of knowledge in the discipline. The candidates will be exposed to cutting edge research and state-of-the art development in the field, with excellent scholarly exchange abilities.

4.    PhD candidates under the Programme should be able to acquire a reasonable command of the Chinese language, which allows them to gain a certain level of knowledge of Chinese law and society, and subsequently enables these PhD candidates to understand a Chinese perspective of International Water Law.

5.    PhD candidates under the Programme will be able to develop abilities and skills in translational research, where theoretical and conceptual foundation of Public International Law and International Water Law could be translated to address real-world problems in order to meet the demands of legal practice.

 

2.   Research Direction

 

(i)    Transboundary Water Cooperation under Public International Law

The primary focus of research is to study the application of the fundamental principles of international law in the promotion of cooperation between states over the utilisation, conservation, and management of international transboundary waters.

 

(ii)  The Development and Use of International and Transboundary Waters under Public International Law

The research seeks to explore the interpretation and application of the principles of international water law, especially the principles of equitable and reasonable utilisation, due diligence duty to prevent significant harm, the duty to cooperate prior notification, and the obligation to conduct environmental impact assessment, as well as other procedural and substantive obligations in governing the utilisation and development of international transboundary waters.

 

(iii)The Protection of Ecosystems of International Watercourses under Public International Law

The research studies the extension of the principles of public international law in the protection, preservation and conservation of the environment and ecosystems of international and transboundary waters, the safeguard of ecosystem integrity, sustainable development, as well as the provision of mitigation and adaptation measures that enhance the resilience of water-related ecosystems against the effects of climate change.

 

(iv) Dispute Prevention and Dispute Resolution under Public International Law

The primary focus of the research pertains to the application of basic principles, methods, means and mechanisms governing the prevention and settlement of international disputes in the resolution of transboundary water dispute by peaceful means, and the promotion of transboundary water cooperation.

 

(v)  The Chinese Perspective and Practice of International Water Law

The focus of the research seeks to develop a deeper understanding of a Chinese’s perspective and practice of International Water Law, and how the practice of a Chinese’s perspective of International Water Law contributes towards the progressive development of International Law in the promotion of cooperation over transboundary waters in the region and beyond. The research further explores the influence of International Water Law in facilitating the successful implementation of the Belt and Road Initiative, as well as the role of the Belt and Road Initiative in advancing cooperation over transboundary waters not only between China and all countries participating in the Belt and Road Initiative, but also cooperation over transboundary waters amongst the participating countries in fulfilling the aim of the Belt and Road Initiative to promote regional and global peace through socio-economic development.

 

3.   Duration of Studies

The duration of studies for the PhD degree in International Water Law is a minimum of 3 academic years, and no longer than 6 academic years.

 

4.   Course Conduct and Credits

(i)     Course Conduct

Reference would have to be made to the “Public International Law (International Water Law) PhD Degree Graduate Course Schedule”, where the common compulsory courses are an Outline of China (2 credits) and the Chinese Language Comprehensive (2 credits). Compulsory courses for the Programme would be Principles of International Water Law (3 credits) and the Seminar on International Water Law (3 credits).

(ii)   Credit Requirements

In order to be qualified for the PhD degree in International Water Law, the candidates would need to complete a course of study consisting of a minimum of 15 credits, with compulsory courses in the discipline of not less than 6 credits, with the rest being elective courses.

 

5.   Requirements for the Application for the Defence of the PhD Thesis in Partial Fulfilment of the PhD Degree

The PhD thesis would have to be written in the English language, and the defence of the PhD thesis would be conducted in English. The details for the application for PhD thesis defence in partial fulfilment of the PhD degree shall refer to the “Wuhan University Provisional Specifications on the Thesis in Partial Fulfilment of the PhD Degree”. PhD candidates are also required to publish one article in SSCI or its equivalent, or two articles in any regular journals in English.
